	By completing this signup application and submitting your details to the DedicatedNOW.com Affiliate Program, you agree that you have read the terms of service in full and fully acknowledge that you are bound by said terms throughout the duration of your relationship with our Affiliate Program: 1.Purpose of the program The DedicatedNOW.com Affiliate Program (herein referred to as "The Program") is designed for the purpose of advertising products and services provided by DedicatedNOW. In exchange for promoting our services, DedicatedNOW will pay a one-time commission for all valid sales referred under your affiliate account. 2.Acceptable Use By completing the application for The Program, you agree to use commercially acceptable and legal means to promote available DedicatedNOW products and services. The use of unsolicited email (i.e. SPAM), advertising on websites featuring illegal material or promoting illegal activities is solely prohibited. As an affiliate of The Program you furthermore agree that you shall not make false claims or violate intellectual property rights on any website featuring links to dedicatednow.com. DedicatedNOW reserves the right to cancel an affiliate account, at its own discretion. 3.Linking to DedicatedNOW Through The Program, graphic banners and linking text are provided for your use in promoting our products and services. You agree not to alter these images or text in any material way. 4.Tracking Codes The Program uses cookies as well as IP-based tracking to credit your affiliate account with any referred sales. If you and another affiliate of The Program both refer the same user to dedicatednow.com, the first affiliate to send the user to dedicatednow.com shall receive the affiliate commission. Cookies originated by The Program are stored on the end-user's computer for a period of 90 days. At any point during this period, should said user signup for DedicatedNOW's services, the affiliate shall receive credit for the sale, assuming no cancellations, charge backs or fraud. 5.Affiliate Payment Payment on all affiliate sales is completed at the end of the referred client's second month of service with DedicatedNOW. Minimum balance required for any affiliate payment is $250. Payment shall be made by the 7th of each month for all affiliates using the PayPal payment option. Payment will be sent via US postal mail to all Affiliates selecting the pay by check option. All payments and commissions due are made at DedicatedNOW's discretion. Example: A visitor from your website clicks on your affiliate coded link to reach dedicatednow.com and purchases a dedicated server for $250 monthly on January 1st. Assuming the transaction is not fraudulent or charged back and the client's server is still active and in good standing, you would receive your commission payment for this server on March 7th. The commission payment on this $250 sale would be either $187.50 (75% payout level), $250 (100% payout level), or $312.50 (125% payout level). Payout level is volume dependent, please see our Affiliate FAQ for more detail. 6.Cancellations, Charge backs and Fraud At the end of the send month's billing cycle for a referred account, our Billing Department will audit the referred account for cancellations, charge backs and fraud. Commissions will not be paid on referred accounts under the following circumstances: a.account cancelled before the end of the second month b.referrals which have charged back their service fees c.fraudulent signups d.activity on the affiliate's behalf, which is prohibited as per the Paragraph 2, Acceptable Use. e.Good Standing: a client's account must be in good standing (i.e. no overdue balances) in order to receive commission payments. 7.Liability DedicatedNOW assumes no liability for damages due to affiliate tracking failures, downtime, loss of data or hacking attempts on The Program. DedicatedNOW does not make any expressed or implied warranties with respect to The Program or its website; nor do we make any claim that our website or The Program will be error free or be in operation 100% of the time. 8.Changes to this Agreement DedicatedNOW reserves the right to change this agreement from time to time, without notice to its affiliates. You agree to be bound by these terms and abide by them while your affiliate account is in operation.
